1. Agreement

By accessing or using QVegas — including the website at qvegas.com, the QVegas iOS app, and QVegas Wellness features — you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

QVegas is operated by VGM, LLC, a Nevada corporation based in Las Vegas, Nevada.

2. Services

QVegas provides:

LGBTQ+ news, arts, culture, and community content (website and app)
A searchable directory of LGBTQ+-owned and affirming businesses and organizations
A digital archive of print publications dating to 1978
QVegas Wellness: health resources, provider directory, crisis support links, and personal wellness features
Account and profile management
Contact forms for editorial inquiries, advertising, and general communication
Horoscopes generated by AI (for entertainment purposes only)

3. Accounts

Some features require a QVegas account, authenticated through Amazon Cognito. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as needed.

QVegas can never access your password. Authentication is handled entirely by Amazon Cognito, a managed identity service. You may sign in with Apple, or with an email and password. Your password is hashed using a one-way cryptographic algorithm before it is stored — meaning it is mathematically irreversible. Neither QVegas staff nor our systems ever receive, store, or have the ability to retrieve your plaintext password. When you sign in, Cognito verifies your credentials directly; QVegas receives only a signed authentication token confirming your identity.

You may delete your account at any time. Upon deletion, all associated data — including wellness records — will be permanently removed from our systems within 30 days.

4. QVegas Wellness

QVegas Wellness features are subject to the following additional terms:

4.1 Not Medical Advice

QVegas Wellness is a personal wellness tracker. It is not a medical device and does not provide medical advice, diagnoses, or treatment recommendations. Behavioral health screenings (including PHQ-9, GAD-7, and AUDIT instruments) are informational tools only and do not constitute a clinical diagnosis. Always consult a qualified healthcare provider for medical decisions.

4.2 Medication Tracking

The medication tracking feature is a convenience tool for recording doses and schedules. It does not replace professional medical guidance. Always follow your healthcare provider's instructions regarding medication use, dosage, and timing.

4.3 Crisis Resources

QVegas Wellness provides links to third-party crisis resources (988 Suicide & Crisis Lifeline, The Trevor Project, Trans Lifeline, Crisis Text Line, SAMHSA). These services are operated by independent organizations. QVegas is not responsible for the availability or quality of third-party crisis services. If you are in immediate danger, call 911.

4.4 Provider Directory

The wellness provider directory lists LGBTQ+-affirming healthcare organizations in the Las Vegas valley. Listings are based on information provided by the organizations themselves and publicly available sources. QVegas does not endorse, certify, or guarantee the services of any listed provider. Inclusion in the directory does not constitute a recommendation. Verify provider credentials, insurance acceptance, and availability directly with the provider.

5. Apple HealthKit

The QVegas iOS app integrates with Apple HealthKit. By enabling HealthKit integration, you agree to the following:

You must explicitly authorize access for each HealthKit data type. QVegas will not access any health data without your permission.
HealthKit data accessed by QVegas is used solely to display your wellness dashboard, track fitness goals, and — if you enable sync — store encrypted wellness records in your QVegas account.
QVegas does not store HealthKit data in iCloud.
HealthKit data is never used for advertising, data mining, or sharing with third parties.
QVegas writes data to HealthKit only for user-initiated actions (such as recording a medication dose). We do not write false or misleading data.
You may revoke QVegas's HealthKit access at any time through your iPhone's Settings > Health > Data Access & Devices.

These terms are in compliance with Apple's App Store Review Guidelines, Section 27 (Health and Health Research). In the event of any conflict between these terms and Apple's guidelines, Apple's guidelines shall prevail.

6. Health Data Privacy

Health data collected through QVegas Wellness is subject to our Privacy Policy, which includes specific provisions for health data protection. Key commitments:

All health data is encrypted in transit (TLS 1.3) and at rest (AES-256-GCM field-level encryption).
Health data is never sold, shared with advertisers, or used for data mining.
You can delete all wellness data at any time.
We follow HIPAA-aligned practices for health data handling.

7. User Conduct

You agree not to:

Use QVegas for any unlawful purpose or in violation of these terms.
Attempt to access other users' accounts, data, or wellness records.
Submit false information to the directory, community features, or provider listings.
Interfere with or disrupt the operation of QVegas services.
Use automated tools to scrape, collect, or harvest data from QVegas.

8. Intellectual Property

All content on QVegas — including articles, images, designs, software, and the QVegas name and logo — is the property of VGM, LLC or its licensors. Our print archive contains publications dating to 1978, and all archival content remains our intellectual property. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Limitation of Liability

QVegas services are provided "as is" and "as available." To the fullest extent permitted by law, VGM, LLC disclaims all warranties, express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of our services, including but not limited to reliance on wellness features, health screenings, medication tracking, or provider directory information.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated through the website or app. Continued use of QVegas after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the State of Nevada. Any disputes arising from these terms or your use of QVegas shall be resolved in the courts of Clark County, Nevada.
